IBM Bulgaria infringes several Labour code articles

Following a request by the President of Bulgarian trade union NFTINI, inspectors from the National Labour Inspectorate checked the compliance of IBM Global Delivery Centre Bulgaria with the labour law and the requirements for ensuring health and safety at work.
During the inspection which took place last month, it was found that:
· the employer does not cooperate with the trade-union and does not create conditions for the execution of its activities and because of that administrative measures and precepts were made to the employer;
· the inspection of the labour files proved that there are infringements in the delivery of the job descriptions and in order to eliminate them compulsory administrative precepts were made;
· the code of practice and the internal regulations for the remuneration setting were approved on 1st January 2010 only which is an infringement of the Bulgarian Labour Code;
· the employer has not ensured periodical measuring of lighting fixture to monitor whether the luminance of the places of work corresponds to the legal provisions and controls of the proper and effective functioning of the ventilation system have not been done. After having done these measurements, an updated risk evaluation for the employees on the ground floor shall be done;
· suitable physiological labour and rest regime for the respective jobs has not been worked out by an agency of labour medicine or specialists working in that field;
· during the inspection no documents were presented showing that the employer informed the employees about health and safety risk evaluation or the measures which shall be undertaken for the elimination of those risks. The prepared risk evaluation does not contain the employee’s positions or their representatives’ or the results of surveys made with them. The periodicity of the risk evaluation by the employer according to the established risk has not been defined.
Compulsory precepts for all the infringements of the labour law found during the inspection were made and certifying protocol was delivered to the employer.
As an answer to a joint letter sent by the General Secretaries of the IMF, EMF and UNI the company declared that “In IBM Bulgaria as in all other countries, we have the highest standards of human resources management, based on our Values, including the right of freedom of association within the framework of the law” and thus the firm “does not recognize or accept your characterization of the situation in IBM Bulgaria.”
