Fight against telecommunications outsourcing and instability in Brazil
The document establishes common ethical, social and professional landmarks capable of preserving the relationship between workers and trade unions against the detrimental effects of these practices, which may lead to the social degeneration of working agreements.
The protocol was signed at Vivo headquarters in São Paulo with the attendance of Almir Munhoz, acting CEO of FENATEL and re-elected for the next mandate of the entity as from February 2012. Antônio Carlos Valente, CEO of Vivo-Telefônica, represented FEBRATEL on the occasion.
“Formalisation of this protocol is a concrete action adopted by FENATTEL and FEBRATEL to fight these practices condemned by us”, declared Almir Munhoz.
Now the document will be discussed in an open court proposed by the TST (Higher Labour Court) on October 4 and 5. FENATTEL currently coordinates the actions of 22 trade unions, in 21 states, in the name of 750 thousand workers, i.e., 95% of the area.
The verbatim document signed by the entities is as follows:
- Publicly express that any condition, requirement or suggestion to the breach of collective standards, such as Collective Bargaining Agreements, work days, benefits or social-economical clauses of same are not the objective of the service agreements, in general, in the network, engineering, hotlines, sales, etc, areas;
- Work together with the hired companies within the Brazilian territory, in general, in the network, engineering, hotlines, sales, etc. areas to prevent measures which may be interpreted as “precarious” for the relationships between workers and trade unions;
- Assure, by means of this joint work, the respect to the right of the workers to freely become a member of a trade union, as well as the recognition and participation of the respective employees in professional telecommunication trade unions;
- Work in the hotlines area - the Brazilian biggest private employer - to assure compliance with the Regulatory Norms, Collective Bargaining Agreements or Collective Bargaining Conventions as regards the working hours, salaries, remuneration and benefits, right to become a member of a trade union, recognition of professional trade unions associated to FENATTEL as representatives of the hotline employees;
- Recognise that persistent innovation, digital conversion and technological evolution are basic characteristics of the telecommunications area which constantly impact the production processes, making impossible to define an end or middle activity in this area;
- Recognise that all and any activity in the area is fundamental for the production chain of telecommunications;
- Recognise that the high degree of complexity and specialization in several activities of the production process is a fundamental characteristic of the telecommunications area;
- Recognise that the general activities of the production process in the network, engineering, hotlines, sales and other areas are autonomous, with several particularities and management models, requiring a high degree of technical specialisation and specification;
- Recognise that the current organization of the area production process, in addition to more formal employment, is essential to the compliance with the constitutional principles and to the efficient offer of services to the final consumer;
- The entities are committed to discuss the creation of a GOOD PRACTICES instrument with rules allowing the self-regulation for services throughout the complete production process, according to the principles of this document.
