Brinks Colombia is trying to destroy the SINTRABRINKS union through arbitrary persecution against its leaders. This activity violates the agreement signed in good faith to advance social dialogue and improve labour relations in September 2012. The agreement was signed in the presence of the ILO Committee of Experts on dispute settlement in Colombia.
The company is manipulative arguments requesting the Colombian justice to eliminate protection of trade union rights of its main leaders, which would leave the union leaderless.
Brinks violated the right to unionise by constantly refusing to allow the union to contact the workers of the company, and dismissed union leaders unjustly accusing them of blockades and stopping activities, among other allegations. Victims of this were the President, Vice President and Public Prosecutor of Bogotá District, JUAN CARLOS RIAÑO MORA, MAURICIO ALFONSO MONTAÑEZ and PEDRO JOSE PITA BERNAL, and the Secretary of Sports of the National Executive Committee, MIGUEL FINCE HERRERA .
Brinks is preparing to give a final blow in the process of leaving the union leaderless: on September 20th, the President of the National Executive Committee, Robinson Becerra Torres, and other leaders are summoned to a hearing aimed at stripping them of union privileges and dismissing them.
It is important to note that although the Colombian government amended the legislation to explicitly prohibit companies in Colombia to use collective agreements or other mechanisms that undermine or discourage union organising, Brinks of Colombia found a shortcut called
"BRINKS INDIVIDUAL PLAN OF EXTRA LEGAL BENEFITS" for THE YEAR 2013/2015, clear evidence of this multinational’s new violations against freedom of association.
UNI will denounce the conduct of this U.S. multinational to national and international legal authorities, as it expressly and clearly contradicts the Obama –Santos Pact.
