1. Background



In order to create a basis for a future presentation of international online rights at the workplace it is necessary to research the different underlying approaches. At the moment, a survey about data on already existing and applied regulations concerning this issue in the various European countries does not exist.



2. Purpose of the Contract



The purpose of the contract is the realisation of the above-mentioned background report. The report will consist of the following elements:



· Research on data to analyse agreements on online rights at the workplace in companies in selected European countries

· Comparative presentation of these agreements

· Editing of the results as a basis of a constructive international dialogue between social partners

·

3. Guidance and indications on tasks and methodology



The consultant will take the following elements into account:

· Principles of existing directives

· Codes of conduct of different companies

· Intensification of the social dialogue between the social partners in the countries of reference



The consultant will analyse selected “best-practice” and negative examples with regard to the impact on workers and he or she will prepare the assessed data as a basis for discussion at the multinational conference. The consultant will present the results at the conference and do a follow-up.



4. Expertise required



The consultant should be familiar with the specificities of the ICT sector and the industrial relations within this sector. Ideally, he or she will have some experience in conducting studies on industrial relations and/or the ICT sector. The consultant will have good knowledge of the new member states and candidate countries and be familiar with their industrial relations systems.



5. Time schedule



The contract starts on 24 October 2008 and ends on 15 January 2008.

Days allocated to external expertise: 16 days. A first version of the background report should be presented to the UNI P&MS steering committee in Brussels on 6 November 2008.



6. Payments and standard contract



The consultant will be drafting the report under the framework of a standard honorary agreement with the project coordinator, UNI-Europa. Payments will be made after receipt of invoice. The consultant will send an invoice covering 70% of the price immediately after the signing of the contract. He or she will send a final invoice of the remaining costs due after sending of the final report.



7. Price



The estimated costs are: number of days 16 x 550,00 EUR = 8 800,00 EUR. The price includes taxes, costs for travel, accommodation and food and overheads (VAT included).



8. Selection Criteria



The Steering Committee will jointly appoint the consultant on the basis of the following selection criteria: level of expertise (expertise requirements mentioned under point 4), coherence of methodology and the price.



9. Award criteria



The contract will be awarded to the tenderer whose offer represents the best value for money taking into account the following criteria:



· Level of expertise

· Coherence of methodology

· Transparency

· Non-discrimination



10. Procedure



Tenderers are required to submit a CV and references.
