The Enforcement Directive is intended to resolve legal and administrative forms of abuse and fraudulent practices when workers are posted temporarily in another country for the provision of specific services. The ETUC, together with the European Trade Union Federations, request that decision makers at European level take the necessary steps to end the cross-border exploitation of workers and the documented social dumping via the fraudulent posting of workers.



It is important to widely distribute and disseminate the joint letter in order to enable the voicing of trade union concerns over this crucial legislative act. The European trade union movement is cautious as the Enforcement Directive could be used to the detriment of workers’ rights. It is imperative to obtain the means and instruments that will allow the effective enforcement of posted workers’ rights, as the current legislative environment does not suffice for the correct and effective application of the Posting of Workers Directive. Indeed, reports from many sectors of abusive and fraudulent posting of workers resulting in the exploitation of posted workers and large-scale social dumping abound.
