The worker fired  by Prosegur in Colombia, who won the right to be reemployed by the company in September 2014, was finally rehired on Wednesday the 11th of March in the city of Pereira. An arrest order against the person legally responsible for Prosegur in the country is still valid as, despite the rehiring of the worker, the company still hasn’t complied with the judicial order in its entirety.

Last Tuesday the 10th of March, the National Police of Colombia visited two Prosegur offices in Bogotá looking for the legal representative of the company in the country, Alejandro Agudelo. Prosegur received a final ruling on the 15th of September 2014 obliging the company to rehire the worker and make salary payments and social security contributions that had not occurred while the employee was dismissed within 48 hours. Prosegur ignored the judicial order despite the appeals process being exhausted. To date, Prosegur still has not paid the missing salary and social security contributions to the worker in accordance with the ruling.

“It is regrettable that Prosegur only respects labour rights and the courts when the National Police come looking for one of their managers”, said Adriana Rosenzvaig Regional Secretary of at UNI Americas. “It is incredible that the company still hasn’t complied with the ruling in its entirety”.

The worker concerned was fired by Prosegur after joining the Sintravalores Union, violating her constitutional rights in Colombia, and her human rights to freedom of association.

The judge in the case referred Alejandro Agudelo to the Attorney General’s  Office to investigate whether procedural fraud had been committed by the legal representative of Prosegur.
