Currently in Peru: The State Ministry has declared that the allegations against union leaders are unfounded.

This is a criminal lawsuit filed by the Spanish security company Prosegur, and the Procuraduría adjunta (Public Prosecution Office) specializing in Law and Order. This claim arose under the accusation of the alleged offense against free movement of transport, communication and other utilities ("disrupting the functioning of public services against the State"). Headed by the Union’s General Secretary, Luis Cardenas, nine members of the Steering committee were indicted. It is claimed that the alleged harm was caused during the strike held on September 13, 2013, that was supported by 500 workers from across the country.

During the strike, 150 workers demonstrated outside Prosegur’s facilities. The company accused 9 union leaders who led the protest, of obstructing the functioning of public services.

After a long trial, the Superior District Attorney’s Office declared that the allegations against union leaders were unfounded, stating, in turn, that the strike was caused by the lack of response from the Spanish multinational to the list of demands submitted by the union, with the main objective of having better working conditions.

The Superior District Attorney’s Office declared the claims to be UNFOUNDED, and resolved to return the case to the provincial prosecutor of origin".

Prosegur, with its systematic practice of disobeying the rules of the countries where it operates, did not only disagree with the initial resolution that declared that the complaint was inadmissible, but it also filed a complaint against the district attorneys, which was also declared UNFOUNDED.

The rulings of the courts of justice in Colombia and Peru continue to show that Prosegur violates human, labor and union rights in these countries, and regards itself as above the law.
