The collective agreement for the retail sector in Geneva protects union activists from discrimination by employers. The labour court followed a request by Unia to adopt provisional measures for Marisa's reinstatement while waiting for the final judgement in order to restore the right to freedom of association at Manor.

The decision by the Geneva labour court to follow the union request represents a historic step in Switzerland regarding the protection of union rights and this is indeed the first time that a Swiss legal authority orders rehabilitation of a union representative.

Marisa Pralong whose contract had been terminated on April 30 has thus once more become a member of staff of Manor. Unia has asked Manor once again to respect Marisa's personal rights and trade-union engagement and to immediately begin negotiations with Unia for the constitution of a workers committee in the company.
